Employers, are you ready for the January 1, 2024 Earned Sick and Safe Time (ESST) requirement?

Here are the highlights

  • Minnesota's earned sick and safe time (ESST) law goes into effect Jan. 1, 2024.

  • Employers must provide each employee working in Minnesota at least one hour of paid sick and safe time for every 30 hours worked, up to a minimum of 48 hours of accrued ESST per year.

  • An employee is anyone who works at least 80 hours in a year for an employer in Minnesota and is not an independent contractor. Temporary, part-time, seasonal, and agricultural employees are covered by this law. There are very few exceptions.

  • An employer's existing leave policy, such as paid time off (PTO), may already meet Minnesota's ESST requirements. Time to review those policies to ensure compliance.
